Temporary or permanent residence in Azerbaijan: which applies?
Temporary residence is a renewable permit of up to one year (up to 3 years for two categories) on a ground set by the Migration Code; permanent residence follows two continuous years on certain grounds. Terms, deadlines and where to apply.

If you plan to stay in Azerbaijan for longer than your visa or visa-free entry allows, whether to work, study, join family or invest, you will come across two terms: temporary and permanent residence. Which one concerns you now, and when does the other become possible? The short answer: the State Migration Service (Dövlət Miqrasiya Xidməti) issues a temporary residence permit on one of the grounds set by the Migration Code, as a rule for no more than one year, and it can be extended each time for no more than two years1. A permanent residence permit, issued for 5 years and extendable for 5 more1, requires two continuous years of temporary residence on a permit issued on certain grounds1,2. In both cases the State Migration Service decides1; this article shows which track to ask about, not whether you qualify.
Three different statuses in the law
Article 3 of the Migration Code (Miqrasiya Məcəlləsi) distinguishes three statuses a foreigner can have in the country4:
| Status | Definition in the Migration Code |
|---|---|
| Temporarily staying | No residence permit; came lawfully for a temporary purpose such as tourism, private business or an official trip |
| Temporarily residing | Holds a temporary residence permit issued under the Code |
| Permanently residing | Holds a permanent residence permit issued under the Code |
A visitor on a visa or visa-free entry therefore holds no residence status: in the Code’s terms they are “temporarily staying”4. Visas are covered in our guide to the Azerbaijan e-visa.
Nor is place-of-stay registration a residence permit. Article 21 of the Code requires foreigners who stay temporarily beyond the period it sets to be registered at their place of stay4; the thresholds and deadlines, including the longer period that applies to citizens of Kazakhstan, are in Place-of-stay registration in Azerbaijan: who, when and how. Under the Law on Registration at Place of Residence and Place of Stay, a person granted a temporary or permanent residence permit is registered at their place of residence at the same time, and this is recorded on the permit document5.

From temporary to permanent residence: the stages as the State Migration Service presents them
- Temporarily staying without a residence permit: entry with a visa or visa-free, with place-of-stay registration if your stay exceeds the period the law sets
- Temporary residence permit on a ground set by the Migration Code: as a rule up to one year (up to 3 years for two categories), extendable each time, as a rule by up to two years; apply at least 30 days before your period of stay ends
- Permanent residence permit: after two continuous years of temporary residence on a ground in Articles 45.1.1 to 45.1.7; apply at least 3 months before the temporary permit expires
- Permanent residence term: 5 years, extendable for 5 years on the holder's application
Temporary residence: grounds and duration
The State Migration Service issues temporary residence permits to foreigners and stateless persons1. You need one of the grounds its page lists under Article 45 of the Migration Code, which include1:
- Family: a close relationship with a citizen of Azerbaijan, or being a family member of a foreigner with temporary or permanent residence.
- Work and study: a work permit, full-time study at a higher education institution or technical school, or being a highly qualified specialist.
- Business: heading (or deputising for the head of) a foreign legal entity’s branch or representative office, heading a legal entity established in Azerbaijan, or entrepreneurial activity there.
- Investment: at least 500,000 manat invested in the economy; at least 100,000 manat in a fixed-term deposit or in government securities (nominal value); or real estate in Azerbaijan worth at least 100,000 manat.
The list also includes other grounds, such as professional religious activity and grounds set by international agreements1. The property ground and its documents are covered in Can foreigners buy property in Azerbaijan?: owning property is a ground to apply, not a permit granted automatically.
Duration: the permit is issued for the period stated in the application, up to one year, and can be extended each time for up to two years1. For two categories, in Articles 45.1.2 and 45.1.4-1 of the Code, the page gives up to 3 years, extendable each time for up to 3 years1.

When permanent residence becomes possible
As the State Migration Service presents it, permanent residence follows temporary residence. You must have lived in Azerbaijan continuously on an appropriate temporary residence permit for the last two years2, issued on a ground in Articles 45.1.1 to 45.1.7 of the Migration Code1. The page excludes family members whose permit derives from a foreigner holding one on the grounds in Articles 45.1.8 to 45.1.11, and cases specified in Article 551.
One of the cases the page lists for permanent residence must then apply, including1:
- A father, mother, spouse, child, brother or sister who is a citizen of Azerbaijan.
- At least 500,000 manat invested in the economy; at least 200,000 manat in a fixed-term deposit or in government securities (nominal value); or real estate in Azerbaijan worth at least 200,000 manat.
- Being a highly qualified specialist or a highly skilled migrant.
- Being a family member of a foreigner with permanent residence, heading (or deputising for the head of) a foreign legal entity’s branch or representative office, heading a legal entity established in Azerbaijan, or entrepreneurial activity there.
The property, deposit and securities threshold here is 200,000 manat, twice the 100,000 manat in the temporary residence list1. Do not assume that the property behind your temporary residence is enough for permanent residence; confirm the threshold with the Service.
Duration: a permanent residence permit is issued for 5 years and can be extended for 5 years on the holder’s application, made at least 3 months before it expires1.
Who decides, where to apply and when
| Question | Temporary residence | Permanent residence |
|---|---|---|
| Who issues the permit | State Migration Service1 | State Migration Service1 |
| Where to apply | ASAN service centres, regional migration departments, or online2 | To the Service; may be submitted electronically1 |
| Latest time to apply | At least 30 days before the period of stay or temporary residence ends1 | At least 3 months before the temporary residence permit expires1 |
| Processing period | 15 or 20 working days2 | 35, 40, 50 or 60 days2 |
The decision: according to its page, the Service considers temporary residence applications taking into account the opinion of the relevant executive authority, and makes the decision on permanent residence itself1. No intermediary can promise you the outcome.
Applying: you apply for temporary residence in person or through your legal representative1. ASAN service states that it handles the issuing and extension of temporary residence permits at all its centres except the Ganja regional ASAN service centre No. 13.
State duty: the processing period follows the Law on State Duty and depends on the duty paid1, hence the alternative periods in the table2. We do not quote amounts; confirm them with the Service or an ASAN service centre.
Before you apply: practical steps
- Identify your ground. Match your situation against the Service’s list, and ask the Service if it is unclear. The ground decides which documents you prepare and whether the permit can later count towards permanent residence1.
- Count back from your deadline. Apply for temporary residence at least 30 days before your current period of stay ends1.
- If you plan on permanent residence, keep your temporary residence unbroken and plan to apply at least 3 months before your temporary permit expires1,2.

When this may not suit you
- Your stay is short. For tourism or a short business visit, what matters is the entry regime and place-of-stay registration, not a residence permit.
- Your ground is not on the list. Do not assume an unlisted ground exists; ask the State Migration Service directly.
- Your case is complicated. If your ground changes, your temporary residence is interrupted, or family members hold permits on different grounds, do not rely on this guide alone. Ask the Service, and consult a licensed lawyer in Azerbaijan if a legal question arises.
- You are buying property mainly for residence. Property is a ground to apply, not a guarantee, and the permanent residence threshold is higher1.
Frequently asked questions
Can I apply for permanent residence straight away?
The State Migration Service requires two continuous years on an appropriate temporary residence permit2, issued on a ground in Articles 45.1.1 to 45.1.7 of the Migration Code1. Ask the Service whether any exception applies to you.
Does a residence permit replace place-of-stay registration?
When a temporary or permanent permit is granted, you are registered at your place of residence at the same time, and this is recorded on the permit document5. Before that, the place-of-stay registration rules apply.
Do I need a visa to leave and re-enter with a temporary residence card?
No, according to the State Migration Service: the card lets you leave and return under a visa-free regime while it is valid2.
